Advances in Marriage Equality - The Wednesday Edition

The Right to Marriage Equality Confirmed in Utah

"A state may not deny the issuance of a marriage license to two persons, or refuse to recognize their marriage, based solely upon the sex of the persons in the marriage union," the 10th U.S. Circuit Court of Appeals said in its ruling on Utah.

Conservative and heavily Mormon, Utah became the 18th U.S. state where marriage rights were extended to same-sex couples when a federal district judge ruled in December 2013 that a state ban on gay matrimony was unconstitutional.

That decision was put on hold by the appeal to the U.S. Supreme Court, but not before more than 1,300 gay and lesbian couples had tied the knot.

ETA: complete ruling is available to read here. Read it, it's beautiful and moving.

Indiana's Marriage Equality Ban Overturned

Separately, a U.S. federal judge struck down Indiana's ban on same-sex marriage as unconstitutional on Wednesday and ordered officials to start issuing marriage licenses.

U.S. District Court Chief Judge Richard Young said the state's ban violated the Constitution's due process and equal protect clauses in the Fourteenth Amendment.

Another great day for equality.

Despite their claims to the contrary, see Rick Santorum, the fight to deny equal marriage rights to the GLBT community is over. Now it's just a matter of getting ALL the ducks in the row.

Did you happen to see anything about the community in South Carolina that voted to limit the powers of their mayor so that they could rehire the lesbian sheriff that he fired unjustly? SOUTH CAROLINA. Classic stuff.

Congratullations!!!

I'm glad that things seem to be getting better in the US and can't help feeling somewhat jealous - I don't know how many years it will take before we even begin considering true marriage equity. Right now, if I "married" another woman (entered a registered partnership with her), I'd give up all my rights to adopt a child (even my partner's) and also all rights for artificial insemination. Because obviously, a gay couple can't make decent parents. Right.

GAH.

Aside from not wanting to be in the wrong side of history I think these judges are in a competition to see who's ruling is going to get quoted in the next generation of social studies textbooks.

It was so exciting to see that a Court of Appeals had upheld one of these marriage equality rulings! Now on to SCOTUS!

More great news! It's amazing sometimes to realize how much our society has turned around on this in so few years.
